INTRODUCTION

At www.tiens.com.my , we value your business and your trust. We recognize that your privacy is very important to you and to most people who use the Internet. This section of our Privacy Policy sets out the principles practiced by us and is detailed below. It is imperative that you read and understand it thoroughly. This policy addresses what information we collect, how we use it, how to correct or change it, and how we protect the changes posted.

This policy may change from time to time and all changes will be posted here on www.tiens.com.my. When so posted, they shall become effective immediately. It is your duty to monitor the changes posted. Use of the site following such changes constitutes your acceptance of the revised Policy then in effect. If you do not agree with the different way we intend to use personal information, you may request in writing that we do not use it in that different way. However if your request affects or hinder or render it difficult or cumbersome to process the orders, applicable bonuses, promotion or benefits we shall have the right to terminate your Membership as the case may be. If you do not object or make such request in writing, you will be deemed to have consented to the use of your personal information in the changed manner.

REGISTRATION

All users must use a confidential password together with the identification number assigned to you in order to log on to the password protected areas of www.tiens.com.my. You shall maintain the confidentiality of any identification number or password. You shall immediately notify us of any unauthorized use of these identifiers, or any other breach of security. You are fully responsible for all activities that occur under these Identifiers. We are not responsible for any misuse of your account by someone who uses your Identifiers.

GENERAL PRINCIPLE

By submitting your personal data to us, you agree and consent to us to collect, use and process your personal data.

We will not process your personal data for any unlawful purpose and will process your personal data for lawful purpose directly related to the matter for which you submit your personal data to us or is necessary or is adequate for that matter or for the other purposes set out below.

CHOICE PRINCIPLE

You have the right not to provide us with any of your personal data but if you wish to join or remain as our Member or wish to obtain further information about us and our products and services or any updates thereof you are obliged to provide us your personal data and if you fail to supply us your personal data we would not be able to process your purchases and applicable bonuses, promotion or benefits or provide you with further information about us or our products or updates.
Your personal data supplied to us is currently processed by us. However we may outsource such processing to other third parties and in such an event we will ensure that your personal data is secured.

We only collect your personal data directly from you and personal data relating to other persons who may be identified from your personal data supplied to us so that we can personally identify you/them or allow the company to contact you/them or to provide services to you/them and to inform you of any promotions, events, new development, new features, services, and products. We do not collect your personal data from other sources. You also have a choice of submitting your personal data to us online or in writing by completing our standard form.

You have the choice of limiting the processing of your personal data for the specific purpose for which you submit your personal data to us. However such limit should not be such as to hinder or render it difficult or cumbersome to process the orders, applicable bonuses, promotion or benefits and in such an event it shall be deemed that you do not consent to us using your personal data and we shall have a right to terminate your Membership as the case may be.

COLLECTION OF INFORMATION

When you visit this Site, we may collect information in two ways through information automatically gathered from your computer or through information you voluntarily provide at this Site. Automatically gathered information are navigational information about where visitors go on our Site, how many visits were made to the Site, when the Site was visited and other non-personally identifiable information (for example domain type, browser version, service provider, IP address). Automatically gathered information is non-personally identifiable.

Our general policy is to only collect individually identifiable information (voluntarily information) that is absolutely necessary for a transaction or which is necessary for our own internal operations such as computation of bonuses, provision of information on our company profile, products, etc. At the time you register to become a member of the Site, you will be asked to complete a registration form which requires you to provide information such as your name, address, contact number, email address, IC number, credit card number (where applicable).

If you purchase a product from this Site, we may collect additional information including billing information, credit card numbers and expiration dates and any other details required for the transaction.

COOKIES

HOW WE USE THE INFORMATION

We may generate reports and analysis based on the Statistical Information for internal analysis, monitoring and marketing decisions. We may provide Statistical Information to third parties, but when we do so, we do not provide personally-identifying information without your permission.

As we continue to develop our business, we might sell or buy stores, subsidiaries, or business units. In such transactions, customer information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Terms & Conditions (unless, or course, the customer consents otherwise). Also, in the unlikely event that we or substantially all of its assets are acquired, customer information will of course be one of the transferred assets.

Other than as set out above, you will receive notice when information about you might go to third parties, and you will have an opportunity to choose not to share the information.

PROMOTIONS

We will periodically send out promotional message to our users. In fact, these will be great offers on selected merchandise currently featured on www.tiens.com.my. Since we have no intention of sending unwanted mail, these messages will only be sent to people who have requested to receive them. Unless you have requested to receive such information from us, we will not rent or sell this list to any third parties. If you have requested to receive such messages from us, you have consented to our sharing, giving, selling, or renting of your name and email address to third parties. If you do not specifically request these messages, they will not be sent to you. If after choosing to receive these email messages from us, you later decide that you wish to stop receiving them, you can easily unsubscribe it by contacting us.

DISCLOSURE PRINCIPLE

We will not without your consent discloses your personal data for any purpose other than the purposes set out herein or for which your personal data was to be disclosed at the time of collection of your personal data or for a purpose directly related to the same.
We will not disclose your personal data to a third party other than with your consent or authority or to the parties set out in this Privacy Policy, for which you have agreed by submitting your personal data and information to us.
We reserve the right to disclose information collected to the relevant authorities if required by the relevant authorities or pursuant to any law or order or we have reason to believe that such disclosure is necessary to identify, contact or bring legal action against someone who may be infringing or threatening to infringe, or who may otherwise be causing injury to or interference with, the title, rights, interests or property of us, , our users, customers, partners, other web site users or anyone else who could be harmed by such activities.

You should be aware that we may disclose specific information about you in response to a subpoena or other judicial order or when we reasonably believe that such disclosure is required by law, regulation or administrative order of any court, governmental or regulatory authority.

If we have reason to believe that a user is in breach of the terms of the User Agreement or the Terms and Conditions or the Member’s Rules and Regulations or any other agreement with us, then we also reserve the right to make public or otherwise disclose such information collected or gathered from a user in order to pursue our claim or prevent further injury/damage to us or others.

Obviously, however, this does not include selling, renting, sharing or otherwise disclosing personally identifiable information from Members for commercial purposes.

Other than as set out above, you will receive notice when information about you might go to third parties, and you will have the opportunity to choose not to share the information. We remind that by using our Site, you shall be deemed to have given your consent to the collection and gathering and use of information collected or gathered by us.

SECURITY PRINCIPLE

We will take all practical steps to protect your personal data from any loss, misuse, modification, unauthorised or accidental access or disclosure, alteration or destruction having regard to the nature of the personal data and the harm that would result from such loss, misuse, modification, unauthorised or accidental access or disclosure, alteration or destruction and the place of location where your personal data is stored and to any security measures incorporated into any equipment in which your personal data is stored and to the measures taken to ensure the reliability, integrity and competence of personnel having access to your personal data and to the measures taken for ensuring the secure transfer of your personal data.
If we do outsource the processing of your personal data to third party or engage a third party to process your personal data, we shall for the purpose of protecting your personal data from any loss, misuse, modification, unauthorised or accidental access or disclosure, alteration or destruction ensure that such outsourcing party or the data processor provides us sufficient guarantees in respect to their technical and organisational security measures governing the processing to be carried out and take reasonable steps to ensure compliance with those measures.
When you place orders or access your account information, we offer the use of a secure server. The secure server software (SSL) encrypts all information you input before it is sent to us. SSL also confirms the identity of the server and tells us that the message arrived safely. Presently we believe this is the most secure system available and offers the strongest possible deterrent against fraud and hackers. Furthermore, all of the customer data we collect is protected against unauthorized access.

RETENTION PRINCIPLE

Your personal data processed for any purpose shall not be kept longer than is necessary for the fulfilment of the purpose for which it is collected and we will destroy or cause your personal data to be destroyed or permanently deleted if it is no longer required for the purpose for which it was to be processed SUBJECT that if any part of your personal data is required by law to be retained or kept for a certain period of time we will only destroy or permanently delete the same after the expiration of such period aforesaid.

We will take all reasonable steps to ensure that your personal data is accurate, complete, not misleading and kept up to date by having regard to the purpose, including any directly related purpose, for which your personal data was collected and further processed. In this respect we may from time request for updated information from you and you are required to exercise due care in entering any data or information given to us.

ACCESS PRINCIPLE

You are entitled to access your personal data held by us and to request for the data to be corrected where your personal data is inaccurate, incomplete, misleading or not up-to-date. We may refuse to comply with your data correction request if we are not supplied with such information as we may reasonably require in order for us to be satisfied as to your identity or we are not supplied with such information as we may reasonably request to ascertain in what way your personal data is inaccurate, incomplete, misleading or not up-to-date or we are not satisfied that your personal data is inaccurate, incomplete, misleading or not up-to-date or we are not satisfied that the correction is accurate complete, not misleading or up-to-date.

Your request for access to your personal data shall be in writing. Your request and access shall only be for your personal information held by us and for us to communicate to you a copy of your personal data in an intelligible form.

We may refuse to comply with your data access request if we are not supplied with such information as we may reasonably require in order for us to be satisfied as to your identity or if you have not supplied us with such information as we may reasonably require to locate your personal data to which your data access request relates or the burden or expense of providing access is disproportionate to the risks to your privacy in relation to your personal data in the case in question or we cannot comply with your data access request without disclosing personal data relating to another individual or providing access would constitute a violation of an order of a court or would disclose confidential commercial information or such access is regulated by another law.
